1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of editapes.com (the "Site") and any purchases made through it. By browsing, creating an account, or purchasing from EditApes, you agree to be bound by these Terms in full. If you do not agree to these Terms, please do not use this Site.
2. What We Sell
EditApes sells downloadable digital design files, including but not limited to SVG cut files, PNG sublimation graphics, print-ready artwork for apparel, clipart, illustrations, and fonts. All products sold on this Site are digital goods delivered by instant download and email — no physical items are shipped.
3. Accounts
You are not required to create an account to make a purchase, though certain features such as order history may require one. If you do create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.
4. Orders & Payment
All prices on the Site are listed in US Dollars (USD) and are subject to change without notice. Applicable sales tax is calculated at checkout based on your location. We accept payment via PayPal, Visa, Mastercard, American Express, and Discover, processed through our secure payment partners.
We reserve the right to refuse, limit, or cancel any order at our sole discretion, including in cases of suspected fraud, pricing errors, or violation of these Terms. If we cancel an order after payment has been captured, we will issue a full refund to your original payment method.
5. Digital Delivery
Upon successful payment, your download link is generated automatically and displayed on the order confirmation page, with a copy sent to the email address provided at checkout. Download links remain active for 30 days and allow up to 5 downloads per order, as described in our Digital Delivery Policy. It is your responsibility to download and save your files within this window; contact us at [email protected] if you need extended access.
6. License Terms
Every design file sold on EditApes is licensed, not sold outright — you are purchasing the right to use the artwork under the terms of the license tier selected at checkout, not ownership of the underlying intellectual property. Three license tiers are available, and the applicable tier is clearly stated on each product listing:
- Personal Use License — grants the right to use the design for your own personal, non-commercial projects, such as gifts, home decor, or one-off crafts. You may not use a Personal Use design to create items for sale, nor may you share or redistribute the file.
- Commercial Use License — grants the right to use the design on physical or digital products that you make and sell yourself, in reasonable small-batch quantities, without additional attribution required. This license does not permit reselling or redistributing the design file itself, and does not extend to large-scale automated print-on-demand storefronts.
- Print-on-Demand (POD) License — grants extended commercial rights specifically for use on print-on-demand platforms such as Etsy, Shopify, Amazon Merch, Printful, or similar services, with no cap on the number of units produced. This license still does not permit reselling the raw design file as a standalone digital product.
Regardless of the license tier purchased, you may never: (a) resell, share, or redistribute the original design file itself in any format; (b) claim authorship or original copyright of the artwork; (c) use the design in any way that is unlawful, defamatory, or infringes on any third party's rights; or (d) sublicense the design to another party. Violation of these license terms may result in the termination of your access to the Site and legal action to protect our intellectual property.
7. Intellectual Property
All content on this Site — including but not limited to design files, product photography, mockup images, logos, text, and site design — is the property of EditApes LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. Except for the limited license granted upon purchase as described above, nothing in these Terms transfers any intellectual property rights to you.
8. User Conduct
When using this Site, you agree not to:
- Violate any applicable local, state, national, or international law
- Infringe upon the intellectual property rights of EditApes or any third party
- Attempt to gain unauthorized access to our systems, servers, or user accounts
- Use automated tools (bots, scrapers) to access or download content from the Site without our written permission
- Upload or transmit viruses, malware, or any other harmful code
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
9. Returns & Refunds
Because all products are digital and delivered instantly, our refund policy differs from a typical physical-goods return policy. Please refer to our Return & Refund Policy for full details on when refunds are available and how to request one.
10. Disclaimer of Warranties
The Site and all products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that design files will be compatible with every version of every software program.
11. Limitation of Liability
To the fullest extent permitted by law, EditApes LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Site or any products purchased herein, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or your use of the Site shall not exceed the total amount you paid for the order giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless EditApes LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, misuse of a licensed design file beyond its granted license tier, or infringement of any third-party right.
13. Termination
We reserve the right to suspend or terminate your access to the Site at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Kent County, Delaware, and you consent to the personal jurisdiction of such courts.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

18. Reviews & User Submissions
If you submit a product review, comment, or other content to the Site, you grant EditApes a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with operating and promoting the Site. You represent that any review or submission you provide is honest, based on your genuine experience, and does not contain false, misleading, or defamatory statements. We reserve the right to remove any submission that violates these standards.

Our Site may contain links to third-party websites or services that are not owned or controlled by EditApes LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. 20. Force Majeure
EditApes LLC shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet or hosting service interruptions, or governmental action.
21. Entire Agreement
These Terms, together with our Privacy Policy, Return & Refund Policy, and Digital Delivery Policy, constitute the entire agreement between you and EditApes LLC regarding your use of the Site and supersede any prior agreements or understandings, whether written or oral.
